Minutes for HB2596 - Committee on Health and Human Services

Short Title

Adding and removing certain substances in schedules I, II, IV and V of the uniform controlled substances act and making conforming changes to the criminal code definition of "fentanyl-related controlled substances."

Jenna Moyer, Revisor of Statutes, provided an overview of HB2596.

Alexandra Blasi, Executive Secretary, Kansas Board of Pharmacy (KBP), provided testimony on HB2596 (Attachment 2). As required by K.S.A. 65-4101 the Kansas Board of Pharmacy is required to submit a report on substances proposed by the Board for scheduling, rescheduling or deletion with respect to any of the scheduled substances. A list of the five substance schedules was provided. The Board regularly works with the Kansas Bureau of Investigation to conduct side by side comparisons of the controlled substances listed in Kansas Schedules I-V to the Federal Controlled Substances list. The Board has determined the need for modifications to the Act. This has resulted in the Board introducing HB2596. A list of the federal changes was provided. In some cases they are just minor edits. Schedule I substances have no medical use in the United States.

Ms. Blasi provided the report to the committee (Attachment 3).

Ms. Blasi responded to questions from the committee.

Nicholas Reinecker, Private Citizen, provided neutral testimony on HB2596 (Attachment 5). While fully supporting the control of synthetic drugs, Mr. Reinecker feels that natural substances, such as marijuana, should be removed from the controlled substance list. This would allow testing for medicinal applications. Mr. Reinecker provided a history of marijuana (Attachment 6).

Mr. Reinecker responded to questions from the committee.

The hearing was closed on HB2596.

Without objection the committee proceeded to final action on HB2596.

Representative Eplee motioned and Representative Ruiz seconded to pass out HB2596 favorably. Motion carried.

The meeting was adjourned at 2:20 PM.
