Transferring authority for certification of continuing care retirement communities from the Kansas insurance department to the Kansas department for aging and disability services and lowering the nursing facility provider assessment for continuing care retirement communities.

Eric Turek, Director of Government and Public Affairs, Kansas Department of Insurance (KDI), provided testimony in support of HB2784 (Attachment 1). HB2784 amends several statutes concerning continuing care retirement communities (CCRC). Our testimony only speaks to the transfer of registrations of CCRCs from KDI to KDADS. The Department is currently limited to the registration of CCRCs and the annual renewal of their certificate of registration, The Department is not involved with the quality care assessments preformed through KDADS. It is more fitting to have the registration and renewal authority to reside with KDADS. The Department has worked with KDADS to ensure they fully understand the registration process. The Department does not have a position on the remainder of the bill.

Steve Anderson, Kansas Medicaid Inspector General, provided testimony in support of HB2784 (Attachment 2). The Office of the Medicaid Inspector General (OMIG) is wrapping up its audit of CCRC and Continuing Care Provider (CCP) application and renewal processing. The audit includes an assessment of the eligibility for a reduced rate of the nursing facility provider tax. The KID expressed that the CCRC and CCP registration/renewal process does not fit within the expertise of the KID. During the audit, there were 285 incomplete registrations or incomplete renewals out of a total of 419 processed, an error rate of 68%. The most common error was that the annual audit certified by a CPA was missing. The OMIG recommends that the CCP registrations be handled by KDADS. KDADS expressed their concurrence with the move.
