The Chair opened the hearing on SB 169.

Nick Myers provided an overview of the bill and stood for questions (Attachment 1).

Ethan Kaplan testified in support of the bill and stood for questions (Attachment 2).  Mr. Kaplan testified that clarification was needed between statutes regarding their rights and the private property rights that deal with topics such as laying fiber optics at a mobile home. 

Martha Smith testified in opposition to the bill and stood for questions (Attachment 3). Ms. Smith stated that the FCC has authority over these issues, including over state and local governments regarding this topic.  The FCC already has protections in place for the consumer in this area.  Mandatory access to all mobile parks without permission by the private  property owner would be a conflict between SB 169 and the FCC.
