Proponents:

Joshua Steward, Chief District Attorney, on behalf of Marc Bennett, District Attorney, 18th Judicial District; Kansas County & District Attorneys Association, testified that this bill proposes three goals: to bring the consequences for Breach of Privacy in cases with child victims in line with other similar statutes and to update the Breach of Privacy statute to account for changes in technology. It raises the burden the State has in proving a violation to the highest "intentional" standard and removes any references to "knowingly" and "for the purpose of". Finally, the proposed bill addresses a parent's or guardian's right to use surveillance to monitor and protect a child while clarifying that this right does not extend to prurient purposes on the part of the parent or guardian.  (Attachment 5)

Ed Klumpp, Kansas Association of Chiefs of Police; Kansas Sheriffs Association; Kansas Peace Officers Association, testified that these associations support the bill, with the change of changing the word "videotape" to "video" where it appears 3 times in existing law in Section 4, subsections (a)(7) and (a)(8).  (Attachment 6)

Kimberly Garnier, Private Citizen, shared the personal experience of her daughter. She pointed out a loophole in that the amendment seems to focus on sexual exploitation without also focusing on the equally serious and harmful problem of privacy violations which happen when a person is being recorded during private activities of daily living. (Attachment 7)
