Chairperson Waymaster informed the committee members that yesterday they started the discussion and action on HB2434.

Dylan Dear, Assistant Director of Fiscal Affairs, Kansas Legislative Research Department, provided a brief description of each handout:

The Committee returned to the discussion on the budget bill.

Representative Francis moved a conceptual proviso, Representative Goetz seconded, for Kansas Department of Transportation (KDOT) to delay, not cancel, a preservation project of a value $130 million to $150 million until the next transportation plan that is not yet to let to bid and is scheduled to start construction in or after Fiscal Year (FY) 2028 in the Kansas City Metropolitan area. The funds from the delayed project will be reallocated $50 million to District 6, $50 million to District 4, and any amounts above that will be split equally between Districts 2 and 3. These projects are to be used for new shoulders and passing lanes as determined by KDOT to be let for construction under the IKE Plan. Motion carried. (Attachment 5)

Representative Moser moved, Representative Hoffman seconded, a language proviso for the Kansas Water Office regarding the State Water Plan Fund for any unencumbered balance in the following accounts in excess of $100 as of June 30, 2026, is hereby reappropriated for FY 2027:  Independent Program Evaluation, John Redmond Reservoir Hydro-suction Pilot Project, and the Water Planning and Project Development. Motion carried. (Attachment 6)

Representative Moser moved, Representative Estes seconded, a Department of Commerce proviso for EDI adjustments as follows: delete $200,000 EDIF from the Rural Opportunity Zones for 2027, leaving a $800,000 balance; delete $500,000 EDIF from the Sunflower Summer Program for 2027, leaving a $2.5 million balance; delete $450,000 EDIF from the Public Broadcasting Grants for FY 2027, leaving a $800,000 balance. Motion carried.

Representative Moser moved, Representative Turk seconded, for a new dairy facility to be funded by the State of Kansas, Kansas State University, and the dairy industry. Each entity will give $5 million for 3 years. Motion carried. (Attachment 7)

Representative Wasinger moved, Representative Hoffman seconded, a Judicial Branch proviso for FY 2027 to conduct educational and conference opportunities, as well as activities sponsored by committees created by the Supreme Court, provided that such expenses shall be in addition to any limitation on official hospitality expenditures. Motion carried. (Attachment 8)

Representative Williams moved, Representative Francis seconded, a Wichita State University's National Institute for Aviation Research (NIAR) proviso to change the sunset date from 2027 to 2028, with an additional $7 million State General Fund (SGF) appropriated for 2028, and to change the name from the Digital Transformational Program to the Military Sustainment Program. Motion carried. 

Chairperson Waymaster moved, Representative Turk seconded, a State Treasurer proviso to increase the aviation loan program for building a hanger for the painting and drying of private aircraft, and accepted the friendly amendment of allowing the loan program for a business that has a majority ownership in Kansas. Motion carried. (Attachment 9)

Representative Estes moved, Representative Ousley seconded, a language proviso associated with the Office of the Governor's budget for child advocacy centers to increase the amount of prevention educational activities to reduce child sexual abuse. Motion carried. (Attachment 10)

Representative Carpenter moved, Representative Goetz seconded, a language amendment for the Kansas Department of Health and Environment--Health to not send out unsolicited voter registration mailers if the individual did not check a box on the application requesting it, provided further that no expenditure shall be made by the above agencies for monies appropriated for such funds or fund for fiscal year (FY) 2027 to mail or deliver an applicant or client a voter registration packet unless the applicant or client checks the yes box requesting the voter registration application form, and make sure the required Federal language is included on the application. Motion carried.

Representative Carpenter moved, Representative Goetz seconded, a Kansas Department for Aging and Disabilities Services (KDADS) proviso regarding item 14, to revert $750,000 into the Community Support Waiver Fund and allow the Community Developmental Disability Organizations (CDDO) to be paid, and removed from the Long-Term Support and Aging Contractual Fund in KDADS's base budget. Motion carried. 

Representative Anderson moved, Representative Francis seconded, a Kansas Department of Insurance proviso to create a pilot reimbursement program for covering evaluation and treatment to help first responders' with post-traumatic stress disorder (PTSD) or acute stress disorder (ASD) through the HERO Pilot Program by appropriating $1 million SGF. Motion carried. (Attachment 11)

Representative Anderson moved, Representative Francis seconded, a Department of Commerce proviso to appropriate $2 million American Rescue Plan Act of 2021 for FY 2027 to expand infrastructure necessary to operate the Beyond Visual Line of Sight service volumes which will put Kansas in a position to secure federal monies and continue precision agriculture, rural medical delivery, and counter unmanned aircraft system (UAS) while working with the Department of Defense. Motion carried. (Attachment 12)

Representative Anderson moved, Representative Hoffman seconded, a Kansas Department of Transportation proviso to appropriate $5 million American Rescue Plan Act of 2021 to support, modernize, and sustain seamless integration for the existing Kansas statewide interoperable communication system. Motion carried. (Attachment 13)

Chairperson Waymaster moved, Representative Williams seconded, a Budget Stabilization Fund proviso for FY 2027, if such balance in the Budget Stabilization Fund equals 20 percent or more of the tax revenue receipts that the interest is then put into SGF and not compounded into the Budget Stabilization Fund. Motion carried. (Attachment 14)

Representative Goetz moved, Representative Turk seconded, a Kansas Department of Education proviso to add language for FY 2027, requiring the agency to provide a report on July 1, 2027, and January 1, 2028, regarding federal funding, including the purposes of federal funding, how it was used, and other accountability elements. Motion carried. (Attachment 15)

Representative Goetz moved, Representative Ousley seconded, a Kansas Department of Education proviso to add $5 million SGF for School Safety and Security grants for FY 2027 and the language from previous years regarding the one-to-one match, and accepted a friendly amendment to be used for new school resource officers. Motion carried. (Attachment 16)

Chairperson Waymaster informed the committee there are additional amendments remaining with the plan being to finish the budget tomorrow with a trailer bill being used to address a pay plan and a few other amendments.
