Chairwoman Estes opened the discussion and action on HB2421.

Chairwoman Estes moved, seconded by Representative Stogsdill to amend page 3, and strike lines 8-20 relating to reporting hours. Motion carried.

Chairwoman Estes moved, seconded by Representative Schreiber to amend page 2 and strike line 25 relating to for "Official school purposes". Motion carried

Chairwoman Estes moved, seconded by Representative Steele to amend page 2(b) lines 27-29 by adding a phrase to require that any social media platform be under the control and monitored by the school district at all times. Motion carried.

Chairwoman Estes stated this amendment was not hers but was brought to her and moved, seconded by Representative Goetz to amend by creating a Section 4 that holds the district harmless for lost or damaged devices. Motion carried.

Representative Chauncey moved, seconded by Representative Steele to insert an amendment on Page 2, line 25 relating to two way texting or calling between teachers or school employees and students is prohibited and improper conduct, unless the teacher or school employee is the parent or person acting as the parent of the student. Motion carried.

Representative Brantley moved, seconded by Representative Steele to amend Page 1, lines 15-16 and remove Kansas accredited non-public elementary or secondary schools from the the entirety of the bill. Motion failed. 

Division was called. There were 9 nays and 7 yeas.

Representative Schmoe moved to amend specifically the cell phone portion to exempt those who are 18 and older and those who are legally emancipated, no second. Motion died.

Representative McNorton moved, seconded by Representative Goetz  to amend page 1, line 22-24 to require all personal electronic devices be turned off and securely locked or stowed away and strike the remainder of the sentence, which would allow School Districts to create their own definition. Motion carried.

Representative Featherston moved to table HB2421. No second.

Representative Goetz moved, seconded by Representative Stogsdill to amend and delay the implementation dates and allow schools to implement during the first or second semester of the school year. Motion failed.

Representative Brantley moved, seconded by Representative Schmoe to amend Page 1, line 16 to strike shall and insert may. Motion carried.

Division was called. There were 6 nays and 11 yeas.

On motion of Representative Featherson, Chairwoman Estes called for a vote to recommend HB2421 as amended, favorably for passage. The motion prevailed.
