Chairperson Petersen opened the Hearing on HB2416. 

Adam Siebers, Staff Revisor gave an explanation of HB2416. (Attachment 1) There were no questions.

Representative Delperdang testified as a supporter of the bill. (Attachment 2) He stated that HB2416 provides essential protections for racing facilities by limiting nuisance actions brought by property owners in surrounding neighborhoods, provided the facility obtained all necessary permits and vested rights prior to surrounding development. This protection is important for facilities that were established before the surrounding properties were purchased. He answered questions from committee members.

Cindy Bell spoke as a proponent of HB2416. (Attachment 3) She said that Kansas tracks are good for Kansas. They provide local entertainment in communities where such is lacking as in Humboldt, Caney, WaKeeney or Stockton. Race tracks bring dollars into those communities as well. She also said that this committee's support and endorsement for passage of HB2416 will protect tracks, along with their communities, economies, and the long-standing racing history in Kansas. She took questions from committee members.

Victor Munoz, in his proponent testimony, said that HB2416 is critical to protecting Kansas' motorsports community and ensuring the continued viability of racing facilities across the state. (Attachment 4) (Attachment 5) HB2416 provides essential protection for racing facilities by limiting nuisance actions brought by property owners in surrounding neighborhoods, provided the facility obtained all necessary permits and vested rights prior to surrounding development.

Chairperson Petersen asked for a motion to approve the committee minutes of January 14, 15, 21, 22, 27, 28, 29 and February 3, 4, 5, 10, 11 and 12, 2026. Senator Tyson offered the motion to approve the minutes, with a second by Senator Argabright. On a voice vote of aye, the motion carried.
