Short Title

Exempting any electric public utility that is a not-for-profit wholly owned subsidiary of an electric cooperative public utility from the jurisdiction of the state corporation commission.

The Chair opened the hearing on SB 348.

Nick Myers, Office of Revisor of Statutes, gave an overview of the bill and stood for questions (Attachment 1).

Reagan McCloud, Director of Government Relations, Kansas Electric Cooperatives, testified in support of the bill and stated that other not-for-profit utilities were in support of this bill (Attachment 2).  The conferee stood for questions.

Lindsay Campbell, CEO of Southern Pioneer Electric Company, testified in support of the bill and shared why they believed the bill was necessary (Attachment 3). The conferee stood for questions.

Justin Grady, Director of Utilities Division, Kansas Corporation Commission, provided neutral testimony on the bill and stood for questions (Attachment 4).

Joseph Astrab, Consumer Counsel, Citizens' Utility Ratepayer Board, provided neutral testimony on the bill and stood for questions (Attachment 5).

The chair closed the hearing on SB 348.

The chair suggested working the bill, if the committee was in agreement.

Senator Francisco moved, seconded by Senator Holscher, that a conceptual amendment be added to SB 348, similar to provisions that exists for other electric cooperatives, that would allow customers an option to opt back into KCC regulation.  The motion carried.

Senator Clifford moved, seconded by Senator Bowers, to pass favorably SB 348 as amended.  The motion carried.
