Minutes for HB2574 - Committee on Legislative Modernization

Short Title

Removing the expiration on certain cybersecurity requirements, modifying the duties of chief information security officers and cybersecurity programs, requiring assessment of executive branch agency compliance with cybersecurity requirements, providing for consideration of such compliance by the legislature during the budget process and creating the judicial branch technology oversight council.

Natalie Scott, Revisor of Statutes, briefed HB2574.(Attachment1)

Representative Kyle Hoffman, House of Representatives, provided testimony HB2574.(Attachment2) The Joint Committee on Information Technology, (JCIT) is also a supporter of the bill. Representative Kyle is the chair of that committee. (2024) SB 291 solved the different standards that Information Technology Executive Committee (ITEC) set. (2024) SB 291 set it out and now it is just for the executive branch. HB2574 is now for the legislative branch also. All branches will work together and have more flexibility to do so. 

Representative Hoffman stated that there is a lot of old language in (2024) SB 291. JCIT felt that developing a cybersecurity program for the department that complies with a national government standard on technology and cybersecurity framework is necessary. He stood for questions.

Jeff Maxon, CITO, testified in support of HB2574. (Attachment3)The bill removes the sunset clause that was placed into (2024) SB 291. The three branches of government are meeting monthly to create new policies and then have Legislative Post Audit, (LPA) verify that progress is being made.  He stood for questions.

Katrin Osterhaus, Legislative Post Audit, (LPA), testified as a neutral conferee on the bill for Chris Clark.(Attachment4) She said there were three points that are important. She spoke about them and they were in the written testimony. She stood for questions.

Mr. Alan Conroy, Kansas Public Employees Retirement System, KPERS, provided neutral testimony(Attachment5) He also requested an amendment to the bill to expressly exclude KPERS from the cybersecurity consolidation provisions contained in section 15. KPERS is governed by a Board of Trustees with fiduciary responsibility to protect the retirement assets and sensitive data of more that 350,000 members, including 117,000 retirees. He stood for questions.
