Chairperson Dietrich resumed work on SB360 from the day before. She offered an amendment to the bill that proposed to exempt self-funded plans under ERISA (Employee Retirement Income Security Act) from the bill's provisions. (Attachment 1) Revisor Eileen Ma explained the amendment.

Senator Fagg moved for the amendment to be adopted. Senator Argabright seconded. Discussion ensued. Motion carried.

Senator Gossage offered an amendment that proposed to remove the dispensing fee. (Attachment 2)

Senator Gossage moved for the amendment to be adopted. Senator Rose seconded. Discussion ensued. Motion failed. A division of vote was called for, 4 were in favor and 5 opposed.

Senator Warren proposed to offer an amendment regarding the reporting of Protected Health Information (PHI) to the Department of Insurance. As that amendment was not yet ready, Chairperson Dietrich ruled to move forward with voting on the bill out of Committee and that Senator Warren could offer that amendment on the Senate floor.

Senator Fagg moved to pass SB360 as amended out of Committee. Senator Argabright seconded. Discussion ensued. Motion carried. A division of the vote was called for, 6 were in favor and 3 opposed.
