Minutes for SB387 - Committee on K-12 Education Budget

Short Title

Providing for the continued enrollment of students who attend a school district of nonresidence pursuant to the school district open enrollment law and authorizing an appeals process for denial of an open enrollment application.

The Chair resumed the committee meeting from recess. The committee went into recess the day prior, March 11, 2024.

 

Representative Estes motioned to amend HB2489 by giving school districts clear authority to dispose of a building if the legislative process does not occur and by requiring school districts to not refuse business to sell, lease, or convey interest in a building or property to a prospective owner or lessee solely because the prospective owner or lessee may use or intends to use the building or property as a nonpublic school building. Representative Thomas seconded. (Attachment 1)

Representative Poskin motioned to amend HB2489 by excluding certain school districts to which the bill may apply to. Representative Winn seconded. (Attachment 2)

Representative McNorton motioned to amend HB2650 by specifying the district is setting its own student academic improvement goals for the two established cohorts. Also establishes the State Board of Education's goal as a separate goal. Representative Hill seconded. (Attachment 4)

Representative Hill motioned to amend HB2650 by using the term "cohort group" instead of "subgroup" and requiring school districts to choose a 3rd grade cohort group and a cohort group from any other grade K-8. Would establish requirements for supports, interventions, and evaluation of cohort groups. Representative Estes seconded. (Attachment 7)

Representative Williams motioned to amend HB2738 by making technical changes to the excess cost calculation. Representative Hill seconded. (Attachment 8)

Representative Estes motioned to amend the appropriate statute to read "sparkwheel" instead of "communities in schools", reflecting the new name change. Representative Thomas seconded. Motion carried. (Attachment 9)

 

 

Representative Goetz motioned to remove the Governor’s recommendation for a step progression of increases of $74.8 million SGF per year for FY 2025 through FY 2029 for additional Special Education State Aid and add $75 million SGF and designate $2.5 million ARPA funds of the 4 million allocated to the e-rate program for a total increase of 77.5 million for special education for FY 2025 and adding language making the $75 million SGF increase in special education funding for FY 2025 contingent upon the passage of the contents of HB2738. Representative Schmoe seconded.

Representative Thomas motioned to delete $4.0 million SGF for parallel test virtual state assessments for FY 2025. Representative Estes seconded. Motion carried.

 

Representative Hill motioned to delete $30.0 SGF for the Childcare Accelerator Grant for FY 2025. Representative Johnson seconded. Motion carried. Representatives Winn, Poskin, and McDonald requested that their "no" votes be recorded.

 

Representative Johnson motioned to add language indicating that the $5.0 million SGF for the Children’s Cabinet public-private partnership is one-time funding for FY 2025. Representative Thomas seconded. Motion carried.

 

Representative Hill motioned to delete $815,000 CIF for the Incentives for Specialty Care program for FY 2025. Representative Estes seconded. Motion carried. Representatives Poskin, Ousley, and McDonald requested that their "no" votes be recorded.

 

Representative Hill motioned to delete $3.0 million SGF for the Mental Health Intervention Team (MHIT) pilot program in FY 2025. This leaves a total of $13.5 million in the fund for FY 2025. Representative Goetz seconded. Motion carried. Representatives Winn, McDonald, Poskin, and Ousley requested that their "no" votes be recorded.

 

Representative Johnson motioned to add language requiring school districts to use $1.9 million SGF of Professional Development State Aid for Science of Reading training or math improvements for FY 2025. Representative Thomas seconded. Motion carried.

 

Representative Estes motioned to add language requiring $1.0 million SGF of the Mentor-Teacher fund be used for funding mentor teachers who are targeting the Science of Reading in grades K-5 for FY 2025. Representative Johnson seconded.

Representative Thomas motioned to add language requiring that the School Safety and Security Grants fund only be used for a pilot program with Zero Eyes to add software to existing cameras to identify guns within schools for FY 2025, require the State Board of Education to select the school districts for the pilot program, and require KSDE to submit a written report on the pilot program’s progress to the House committee on K-12 education budget and the Senate committee on Education by January 15, 2026.  Additionally, delete current proviso language which states that school districts will match the grant $1 for $1 for FY 2025. Rep Schmoe seconded. (Attachment 10)

Representative Goetz motioned for the appropriations as amended for the Department of Education for fiscal years 2024, 2025, and 2026 as provided in sections 69,70, and 71 of HB2802 as amended be placed into SB387. Representative Thomas seconded. Motion carried. Representative McDonald requested that her "no" vote be recorded.

 

Representative Goetz motioned to pass SB387 as amended and that the revisor incorporate and prepare all such contents and amendments into a substitute bill, House Substitute for SB387. Representative Thomas seconded. Motion carried. Representative McDonald requested that her "no" vote be recorded.
