76-2007f. Each of the leases entered into pursuant to the provisions of this act shall contain the following restrictions or limitations on the use of the tracts of land so leased: (a) No earth-altering operation, other than landscaping, shall be undertaken on such property without the written consent of: (1) The Kansas state historical society, with respect to that portion of the tract of land described in subsection (a)(1) of K.S.A. 76-2007d which is under the jurisdiction of said society; or (2) the state board of regents, with respect to that portion of the tract of land described in subsection (a)(1) of K.S.A. 76-2007d which is under the jurisdiction of said board and the tract of land described in subsection (a)(2) of K.S.A. 76-2007d; (b) the city, or its designated agent, shall be liable for any damage to any state-owned property or injury to any persons; and (c) the state shall reserve the right to enter the premises and excavate any area of historical significance on the property leased. |
